What this means for you and your clients

New York State legalized gay marriage in 2011 and the country made it the law of the land in 2015. A triumph for the LGBTQ community? To be sure. This is a triumph of monumental proportions.

This is just the tip of the iceberg in understanding the many complexities of LGBTQ family law, especially as it pertains to same sex partners and their children. The laws are incredibly different from state to state. If you think New York has been one of the most progressive states in regard to custody and visitation rights of same sex couples-especially if married-think again. Surprisingly, New York has presented some very unwelcome roadblocks. However, the landscape is changing and it is imperative that we keep up with the changes that are occurring.

We are proud and excited to have a workshop presenter who is at the forefront of understanding the NY State laws and is helping her clients navigate our complex and ever changing system.

Sherri Donovan, ESQ will discuss the history of NY law as it pertains to LGBTQ families and what LGBTQ community members and professionals in the helping fields must know to stay current and educated.

The cases that Sherri will be presenting represent the discrimination that New York State has displayed to same sex families-and in each successive case how brave legal challenges have been waged and won to chip away at these discriminations. We have more to do-but please attend so that we can understand the issues and progress made thus far.

This is the outline for our presentation:

1. Legality of Marriage in 2011 but still:
Discrimination and Segregation in Parenting for same sex families- the Allison D and Deborah H cases;

2. The U.S. Supreme Court, Recognition of The Stigma to Children in Same Sex Families - the Obergefell case;

3. The Wonderful Legacy of the Visionary, (recently deceased) Hon. Sheila Abdul Salaam - The Brooke Breakthrough in the Court of Appeals - August 30th, 2016

4. Post- Brooke: Retroactivity; Orders of Parentage, 3 Parents; Defacto Parenting And the Status of Adoption.
